These Website Terms of Use ("Terms") govern your access to and use of the Trustark website located at https://gettrustark.com and all related subpages and microsites (collectively, the "Website"), operated by Servana Pty Ltd, a private company incorporated under the laws of the Republic of South Africa (registration number: 2025/897026/07), with its registered address at 95 OWL ROAD, KIKUYU ESTATE, MIDRAND, GAUTENG, 2090 ("Servana", "we", "us", or "our").
These Terms apply to all visitors, users, and others who access the Website, regardless of whether they are registered customers of the Trustark platform. By accessing or using the Website, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the Website.
1. About the Website#
1.1 The Website is a marketing and informational website for the Trustark security trust management platform. The Website provides information about the features and capabilities of the Trustark platform, pricing (where published), company information, blog content, and links to the platform application.
1.2 Access to the Trustark platform application at https://app.gettrustark.com is governed separately by our Terms of Service, which apply to registered customers.
1.3 Certain pages on the Website, including public Trust Portal pages accessible at https://gettrustark.com/trust/[slug], are published by Trustark customers for the purpose of sharing security posture information with their own stakeholders. Servana is not responsible for the accuracy or completeness of content published by customers on their Trust Portals.
2. Eligibility and Access#
2.1 The Website is accessible to the general public. There is no age restriction on accessing general informational content. However, if you wish to register for the Trustark platform, you must be at least eighteen (18) years of age and have the legal capacity to enter into binding contracts.
2.2 Servana reserves the right to restrict, limit, or terminate access to the Website at any time, without notice, for any reason, including where we reasonably believe a user is in breach of these Terms or applicable law.
2.3 You are responsible for ensuring that your device, browser, and internet connection are adequate to access the Website. Servana does not guarantee that the Website will be compatible with all devices or browsers.
3. Acceptable Use of the Website#
3.1 You may use the Website only for lawful purposes and in accordance with these Terms. You must not use the Website:
(a) in any manner that violates any applicable South African law or regulation, including the Cybercrimes Act 19 of 2020, POPIA, or ECTA;
(b) to transmit, upload, or distribute any content that is unlawful, harmful, defamatory, obscene, fraudulent, or that violates the rights of any third party;
(c) to engage in any activity that could harm, disable, overburden, or impair the Website or its infrastructure, or interfere with any other user's access to the Website;
(d) to attempt to gain unauthorised access to any part of the Website, its servers, or any system or network connected to the Website;
(e) to use automated tools, scrapers, crawlers, or bots to access, extract, or copy content from the Website without Servana's prior written consent;
(f) to impersonate Servana, any Trustark customer, or any other person or entity, or to misrepresent your affiliation with any person or entity;
(g) to introduce or transmit any malware, virus, Trojan horse, worm, or other malicious or harmful code;
(h) to use the Website for the purpose of competitive intelligence gathering or to develop a competing product or service without Servana's prior written consent; or
(i) to collect or harvest Personal Information of other users from the Website.
3.2 Servana reserves the right to take any action it deems appropriate in response to suspected violations of this clause, including blocking IP addresses, referring matters to law enforcement, and pursuing legal action.
4. Intellectual Property#
4.1 Ownership. The Website and all content published on it, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and the design and layout of the Website ("Website Content"), are owned by or licensed to Servana and are protected by South African and international copyright, trademark, and other Intellectual Property Rights.
4.2 Limited Licence. Servana grants you a limited, non-exclusive, non-transferable, revocable licence to access and view the Website and its content for personal, non-commercial, and informational purposes only. This licence does not grant you any right to:
(a) copy, reproduce, distribute, or republish any Website Content except for personal, non-commercial use;
(b) modify, adapt, translate, or create derivative works from any Website Content;
(c) use any Website Content for commercial purposes without Servana's prior written consent; or

4.3 Trademarks. "Trustark", the Trustark logo, "Servana", and all related names, logos, product and service names, designs, and slogans are registered or unregistered trademarks of Servana. If you submit any content to Servana through the Website (including through contact forms, feedback tools, or waitlist registrations), you grant Servana a non-exclusive, royalty-free, perpetual licence to use such content for business purposes, including improving the Website and Services.

5.1 THE WEBSITE AND ALL WEBSITE CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

6.4 Servana is not responsible for any loss or damage arising from your use of or reliance on any content, goods, or services available through External Sites.
7. Limitation of Liability#
7.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE SOUTH AFRICAN LAW, SERVANA SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE LOSS OR DAMAGE ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE OR ANY WEBSITE CONTENT, INCLUDING:
(a) LOSS OF REVENUE, PROFIT, DATA, BUSINESS, OR GOODWILL;

7.3 To the extent that Servana's liability cannot be excluded under applicable law (including the Consumer Protection Act 68 of 2008 where applicable), Servana's liability is limited to the maximum extent permitted by law.
7.4 Nothing in these Terms excludes or limits Servana's liability for: (a) fraud or fraudulent misrepresentation; or (b) death or personal injury caused by Servana's gross negligence.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a competent court, that provision shall be severed from these Terms to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
13. Waiver#
No failure or delay by Servana in exercising any right under these Terms shall constitute a waiver of that right. Any waiver must be in writing and signed by an authorised representative of Servana to be effective.
